PointGenie – Global Privacy Policy

This Privacy Policy explains how PointGenie LLC ("PointGenie," "we," "us," or "our") collects, uses, stores, discloses, and protects personal information across our websites, mobile applications, APIs, business dashboards, NFC-enabled products, QR codes, and related services (collectively, the "Platform"). It covers the entire Platform, including PoX, check-ins, business accounts, free QR claims, GenieTags, and White Glove services.

1. Information You Provide

  • Account and profile information, including name, username, email, phone number, authentication identifiers, profile photo, language, and preferences.
  • Business information, including business name, category, address, contact details, hours, logo, menus, services, social links, and proof that you are authorized to manage a location.
  • Content you choose to share, including check-ins, photos, videos, reviews, comments, events, experiences, messages, and communications with us.
  • Order and lead information, including selected products, free QR claims, White Glove requests, shipping and billing contact details, coupon use, and order history.

2. Information Collected Automatically

When you use the Platform, we may collect IP address, device and browser type, operating system, app version, device identifiers, language, referring pages, timestamps, crash and diagnostic data, feature interactions, and security logs. We use cookies, SDKs, and similar technologies to operate and improve the Platform.

3. Location and Check-Ins

Precise location is collected when you initiate a location-dependent action, such as confirming a check-in or finding nearby places, and grant the required device permission. PointGenie does not continuously track precise location in the background without an enabled feature, permission, and lawful basis.

A check-in may include the selected place, time, crowd level, wait time, vibe, media, and engagement. Depending on your settings and the feature, some of this information may be public or shared with a business, other users, or recipients of a shared link.

4. Business Listings and Claims

Business listings may contain information from public sources, business owners, users, and providers such as mapping or business-directory services. When you search for or claim a business, we may process the query, selected location, and verification details.

5. QR Code and GenieTag Analytics

When someone scans or taps a PointGenie QR code or GenieTag, we may record the tag or code identifier, destination, timestamp, approximate location derived from IP, device and browser information, and subsequent actions on the landing page. We use this data to operate links, detect abuse, and provide aggregated analytics to the associated business. An NFC tag does not give PointGenie access to unrelated information stored on a visitor's phone.

6. Purchases, Payments, and Fulfillment

Payment-card details are collected and processed by an authorized payment provider such as Stripe. PointGenie does not receive or store complete card numbers. We and our processors receive transaction identifiers, payment status, billing details, and fraud signals. Necessary contact, address, and order details may be shared with printing, fulfillment, and shipping providers.

7. Third-Party Accounts and Integrations

If you connect or interact with Google, Apple, maps, social networks, messaging services, or other third parties, we may receive information allowed by your settings and authorization. Third-party services process information under their own privacy policies.

8. Automated and AI-Assisted Features

PointGenie may use automated systems and service providers to rank public content, identify notable check-ins, prevent fraud, translate content, and generate draft marketing assets such as social cards, captions, flyers, carousels, or videos from eligible check-ins, events, and business information. Drafts may be reviewed before publication. We do not use automated processing to make decisions that produce legal or similarly significant effects without appropriate notice and safeguards.

9. How We Use Information

  • Create, authenticate, and support user and business accounts.
  • Operate check-ins, live place signals, events, experiences, sharing, and notifications.
  • Generate, activate, and route QR codes and GenieTags.
  • Process orders, deliver products, and perform White Glove onboarding.
  • Provide dashboards, aggregated analytics, and business insights.
  • Personalize content and improve performance, safety, and accessibility.
  • Detect spam, duplicate claims, fraud, security incidents, and policy violations.
  • Comply with law, enforce agreements, and protect users, PointGenie, and the public.

10. How We Share Information

We do not sell personal information for money. We may disclose information to service providers supporting hosting, analytics, communications, customer relationship management, payments, AI processing, security, printing, fulfillment, and shipping; to users or businesses when you intentionally publish or interact; to integrations you direct us to use; to authorities when legally required; or in connection with a business transaction.

11. Communications and Push Notifications

We may send transactional email, SMS, WhatsApp messages, or push notifications about account security, orders, claims, activations, events, and service changes. Promotional communications are sent where permitted by law. You can use unsubscribe controls, reply STOP where supported, change device settings, or contact us. Opting out of marketing does not stop essential service messages.

12. Cookies and Similar Technologies

We use necessary cookies for sessions, security, language, and checkout; preference cookies for remembered choices; and analytics technologies to understand use and improve the Platform. Advertising or cross-context tracking technologies, if used, are subject to applicable consent and opt-out requirements.

13. Public Content

Information published to a public profile, business page, check-in, experience, or event may be seen, copied, or reshared by others and may appear in search engines. Businesses generally cannot remove accurate public facts or independent user content solely by closing an account.

14. Data Retention and Security

We retain information for as long as needed to provide the Platform, maintain required records, resolve disputes, prevent fraud, and comply with law. We use commercially reasonable administrative, technical, and organizational safeguards, but no system can guarantee absolute security.

15. International Transfers

PointGenie operates globally. Information may be processed in the United States and other countries whose privacy laws differ from those where you live. Where required, we use recognized transfer mechanisms and contractual safeguards.

16. Your Privacy Rights

Depending on your location, you may request access, correction, deletion, restriction, or portability; object to certain processing; withdraw consent; opt out of certain targeted advertising or sharing; and appeal a denied request. We may verify your identity and authority before completing a request. You may exercise rights without unlawful discrimination.

17. Children and Account Deletion

The Platform is not directed to children under 13, or the higher minimum age required by local law, and we do not knowingly collect their personal information.

You may request deletion through available account controls or by contacting [email protected]. After identity verification, we will delete or de-identify eligible account information, typically within 30 days, subject to legal, security, fraud-prevention, and recordkeeping exceptions.

18. Changes and Contact

We may update this policy as the Platform or law changes. We will post the revised version with an updated date and provide additional notice when legally required.
